Learned counsel for the petitioners submits that the petitioners are senior to respondent No.3-Darshan Dass, however, it is noticed that there is no seniority list published by which the petitioners are placed/shown senior to respondent No.3-Darshan Dass.

The claim of the petitioners for stepping up of their pay at par with said Darshan Dass has been rejected by the respondents on the ground that Darshan Dass is senior to the petitioners. 3.

The question regarding the inter se seniority is to be decided only by the respondent-Department and as no seniority list is published till date, it cannot be said that the petitioners are senior or vice versa. In view thereof, the said issue is still open and to be examined only after the final seniority list is published.
