ALKA SARIN, J. (ORAL) 1.

The present appeal pertains to the year 1997. Vide order dated 08.04.2024 notice was issued to the appellants as learned counsel appearing on their behalf had pleaded no instructions in the matter. As per the Office report, notice issued to the appellants has been received back unserved with the report that they are not residing at the given address. There is no other address of the appellants available with the Court for effecting their service except the one mentioned in the memo of parties and in the judgments and decrees passed by both the Courts concerned and is the same on which the notice was sent.

In view thereof, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.
