***** GURVINDER SINGH GILL, J. (Oral) The petitioner seeks grant of anticipatory bail in respect of FIR No.108 dated 21.05.2017, registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Kotwali Kapurthala, District Kapurthala.

Consequent upon the absence of the petitioner before the trial Court as on 21.10.2017, his bail was cancelled and non-bailable warrants were issued for securing his presence.

Learned counsel for the petitioner has submitted that his absence on 21.10.2017 was the first instance of default on his part. Learned counsel has today furnished a copy of order dated 12.07.2018 passed by Special Court, Kapurthala, wherein, pursuant to direction issued by this Court, the petitioner has appeared before the trial court. CRM-M-27224-2018 --2-- Learned State counsel has not disputed the said fact. Bearing in mind that it is a case of first instance of default on the part of the petitioner, present petition, as such, is accepted and interim directions issued by this Court vide order dated 04.07.2018 are hereby made absolute subject to the condition that the petitioner shall appear before the Investigating Officer as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C..
