The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.18 dated 11.03.2016 under Sections 323, 324, 326, 148 and 149 IPC, registered at Police Station Chabbewal, District Hoshiarpur.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the FIR in the present case has been registered on the statement of Mohan Lal @ Monu. It is stated in the FIR that Devinder Singh was armed with khanda and he gave khanda blow Vineet Gulati 2016.09.15 17:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-27160 of 2016 -2which hit the complainant on the thumb of his left hand. The other injuries given by co-accused are simple injuries. It is stated that both the parties are students.

Keeping in view the above facts and circumstances and the fact that grievous injury is on the thumb of the complainant and without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that no useful purpose will be served by sending the petitioner to custody.

Therefore, finding merit in the present petition, the same is allowed. It is ordered that in the event of arrest, the petitioner be released on anticipatory bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
