On asking of the Court, Mr. Deepak Sabharwal, Addl.A.G Haryana, accepts notice on behalf of the respondent-State. Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.74 dated 04.05.2020, registered at Police Station Odhan, District Sirsa, who has been booked for having committed the offence punishable under Section 22-C of NDPS Act. Learned counsel for the petitioner submits that the petitioner was named in the F.I.R on the disclosure statement of Prem Kumar, from whom the 1050 tramadol tablets were recovered. Nothing has been recovered from the petitioner. He was not present on the spot. Learned State counsel on the other states that the allegations against the petitioner that he supplied the alleged tablets to co-accused Prem Kumar. Further the recovery of 1050 tramadol tablets falls under commercial quantity.

Crl. Misc. No. M-13912 of 2020 -2Learned State counsel on instructions further submits that three other cases are pending against the petitioner out of which one case is under NDPS Act i.e F.I.R No. 101 dated 15.07.2019 in which challan has been presented against the petitioner. The recovery was of noncommercial quantity. Keeping in view the above fact , no case is made out for grant of anticipatory bail to the petitioner.

Dismissed.
