**** RAJ MOHAN SINGH, J. (Oral) Admittedly, a civil suit was filed by the petitioner in the context of penal rent and the same was dismissed by the trial Court on 05.04.2018. An appeal was preferred against the aforesaid judgment and decree before the lower Appellate Court and the appeal was got dismissed as withdrawn on 07.12.2021 with liberty to avail any other remedy in accordance with law. Evidently, the decision of the trial Court dated 05.04.2018 has not been annulled so far.

After arguing this case for some time, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file an appropriate application for revival of appeal before the lower Appellate Court.
