NARESH KUMAR SANGHI, J. (Oral) Learned counsel for respondent No. 2 has pointed out that charge for the offence punishable under Section 420, IPC, was framed on 28.1.2015 and the said order has not been challenged by the petitioner.

In view of above, learned counsel for the petitioner prays for withdrawal of the present petition to enable the petitioner to challenge the said order by filing criminal revision petition PRASHANT KAPOOR 2015.10.09 13:18 I attest to the accuracy and authenticity of this document

CRM-M-26354-2014 (O&M) before the Court of Session at the first instance. Learned counsel for the respondents have no objection to the above prayer.

After hearing learned counsel for the parties, the present petition is disposed of with permission to the petitioner to file criminal revision petition before the Court of Session at the first instance.

It is directed that in the event the petitioner prefers criminal revision petition within three weeks of passing of this order alongwith an application under Section 5 of the Limitation Act, 1963, for condonation of delay in filing criminal revision petition, the application shall be considered sympathetically in view of the fact that the petitioner has approached this Court by way of present petition.
