The present petition has been filed under Section 528 of BNSS, 2023, challenging the order dated 05.02.2026 passed by learned Special Judge, PMLA, Gurugram, in COMA 01 of 2014, whereby the application under Section 256 BNSS filed by the petitioner seeking permission to produce a defence witness, was dismissed. 2.
Learned Senior Counsel submits that the petitioner wants only one opportunity to examine the manager/any concerned officer of IndusInd Bank, alongwith documents, as mentioned in para No.4 of the application dated 27.11.2025, Annexure P-2 and that he would not seek to call any other witness in defence, for which reference is made to para No.5 of his affidavit, Annexure P-3.

Learned Special Counsel for the respondent-ED opposes the application, it being wholly unwarranted, however, submits that in case the Court is inclined, in that eventuality, not more than one opportunity be granted to the petitioner to examine the said witness. 4.
Having heard learned counsel for the parties and keeping in view the facts and circumstances of the case, it would be in the interest of justice to grant one opportunity to the petitioner to examine the Manager/ representative of IndusInd Bank along with the documents as mentioned in para 4 of the application dated 27.11.2025 (Annexure P-2), with a caveat that in case the documents referred to in the application are not available or cannot be produced, no further adjournment on that account shall be sought or granted. The same shall be subject to the cost of Rs.25,000/- to Sai Aasra Paraplegic Rehab Centre (Kotak Mahindra Bank, Branch Sector 27 D, Chandigarh, Account No: 9612001641, IFSC: KKBK0004201.
