(Oral) The allegations against petitioner Roshan Singh @ Roshi in this regular bail application under section 439 Cr.P.C. are that on 16.3.2016, the petitioner along with his mother Dalbir Kaur were accosted leading to scuffle whereby the petitioner has given kirpan blow on the finger of right hand of Gauravdeep Singh which is opined to be simple in nature. The contentions of counsel for the petitioner are that the petitioner is in custody since 17.3.2016 and that the culpability, if any, shall be determined at the time of trial.

Without going into the merits of the case, in the light of the fact that the investigations and trial are not likely to be concluded in the near future, this Court is of the opinion that further detention of the petitioner in the present case is not warranted.
