**** DEEPAK GUPTA, J. (ORAL) The appellant-claimant had sustained injuries in a motor vehicular accident on 13.04.1997 due to rash and negligent driving of truck No.HP-23-1821. He sought compensation under Section 166 of the Motor Vehicles Act, 1988 from the driver, owner and insurer of the offending vehicle.

Learned Tribunal vide order dated 16.05.2001 had assessed the compensation to the tune of 50,000/- and made all the three respondents jointly and severally to make payment along with interest with recovery rights in favour of the Insurance Company.

Seeking enhancement in the present appeal, the only contention raised by learned counsel is that appellant had suffered 20% permanent disability and that only an amount of 50,000/- has been allowed by the Tribunal.

However, as rightly pointed out by learned counsel for the Insurance Company, there is absolutely no evidence that on account of the permanent disability suffered by the appellant, he suffered any loss of VIVEK PAHWA 2026.01.12 19:34 I attest to the accuracy and integrity of this document Chandigarh

Before this Court also, learned counsel for the appellant conceded the fact that there is no evidence available to show that salary of the insured-appellant was reduced on account of the permanent disability affecting his earning capacity.
