4, At request, the present matter has been taken up in National Lok Adalat.

Present appeal has been filed by owner of the offending vehicle against the impugned Award dated 03.09.2024 whereby recovery rights were given to Insurance Company.

Learned counsel for Insurance Company submits that the Insurance Company agrees for full and final settlement with claimants by waiving recovery rights.

In view of the above, learned counsel for appellant submits that he does not want to pursue this appeal and same be disposed off as withdrawn. Ordered accordingly.

It is clarified that the Statutory amount of Rs.25,000/- be refunded to appellant.

Pending application(s), including applications for condonation of delay and for leading additional evidence, shall also stand disposed off.
