The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to renew his Biometric Aerodrome Entry Pass/Airport Entry Pass. 2.

On 10.03.2026, the following order was passed by this Court:- "Inter alia contends that petitioner has applied for renewal of his biometric Aerodrome Entry Permit, however, respondent has withheld his application on account of pending criminal case against him. He was implicated in FIR No.169 dated 13.06.2024 registered under Sections 376(2)(n) of Indian Penal Code at Police Station Sector 14, Gurugram. He has filed CRM-M505702024 seeking quashing of aforesaid FIR before this Court. Notice of motion has been issued and matter is still pending before this Court.

Learned counsel for the respondent seeks short accommodation to ascertain reason and justification for withholding of petitioner's application.

During the course of hearing, learned Senior Counsel for the respondent produced copy of order dated 02.04.2026 passed by Director General, Bureau of Civil Aviation Security. The same is taken on record. Registry is directed to tag the same at an appropriate place. 4.

As per paragraph No.8 of the aforesaid order, it is an appealable order and appeal lies before Secretary, Ministry of Civil Aviation, New Delhi.

Learned counsel for the petitioner submits that Appellate Authority may be directed to consider his stay application in case he files appeals within a week from today. There would be severe repercussions if petitioner's stay application is not considered. 6.

Learned counsel for the respondent does not oppose aforesaid prayer.

In the wake of statement of both sides, the instant petition stands disposed of with a direction to Appellate Authority to consider petitioner's stay application, if filed within a week from today, at the earliest and pass an appropriate order within a week from the date of filing.
