This is a petition for grant of regular bail to the petitioner in case FIR No. 91 dated 8.6.2015, registered under Sections 307, 323, 148 & 149 IPC and Section 25 of the Arms Act, 1959, at Police Station Morinda, District Rupnagar.

As per the allegations, five persons including the petitioner went to the shop of the complainant where there was some altercation and one Harman Gujjar also fired a shot which hit the thigh of the brother of the complainant.

Learned counsel for the petitioner has argued that apart from this grievous injury, all other injuries are simple and none has been attributed to the petitioner and has now been in custody for about two DEEPAK KUMAR BHARDWAJ 2015.08.31 10:39 I attest to the accuracy and authenticity of this document

Learned Assistant Advocate General has also placed on record custody certificate of the petitioner. As per the custody certificate, it has been borne out that the petitioner has already undergone a period of 1 months & 14 days in custody. Learned Additional Advocate General has also accepted that apart from the gun shot injury, which is not attributed to the petitioner, there are two other injuries suffered by the brother of the complainant. Without going into the merits of the case, I do not deem it appropriate to deny the petitioner the concession of bail. Thus, the present petition is allowed and the petitioner is released on regular bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Rupnagar.
