 "#$ !% Allegations against the petitioner Sukhbir @ Sukhia in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.145 dated 03.08.2013 registered at Police Station Siwani, District Bhiwani under Sections 148/149/323/506/325/427/302/120B IPC, are that he along with his co:accused were instrumental in assaulting Surender and deceased Mahipal by means of lathis, dangs and rods.

Contentions of learned counsel for the petitioner Mr. R.S. Panghal, Advocate that similarly placed co:accused Ramphal @ Bhilda has already been granted bail by this Court vide order dated 17.07.2015 and the case of the present petitioner is not RATTAN PAL SINGH 2015.08.25 14:02 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court



   distinguishable from that of his co:accused, though is sought to be controverted by learned State counsel who has opposed the bail application.

However, having regard to the fact of principle of parity and that there is no specific role attributed to the petitioner in commission of the offence and that animosity between Sher Singh and Anoop with deceased Mahipal and how the petitioner is connected in commission of the crime, are matters of trial together with the fact that the trial will take a long time to conclude, this Court is of the opinion that no useful purpose will be served by keeping the petitioner behind bars in the present case. Accordingly, he is ordered to be released on regular bail to the satisfaction of trial Court. The present petition stands disposed off accordingly. $  "%   &'&()*#
