This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 264 dated 10.04.2017 under sections 323, 307, 506, 34 IPC and section 27 of the Arms Act at Police Station Jhajjar. In the altercation which occurred on 10.04.2017, petitioner is stated to have fired shots from his licensed pistol. One such shot hit injured witness namely Dinesh. Trial of the case is in progress. Out of twenty five witnesses cited by the prosecution, twelve have been examined. Plea of the petitioner is that private witnesses have been examined and they turned hostile. Petitioner is stated to be in custody since 11.04.2017.

In the facts and circumstances of the case, petition is allowed and it is directed that petitioner be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jhajjar. Aforesaid order shall not affect the merits of the case.
