Mr. Rohit Rana, Advocate, for the petitioner. **** RITU BAHRI , J. (Oral) The present petition is for issuance of direction to the respondents to consider his candidature under General Category instead of General ESP. The precise grievance of the petitioner before this Court that while filling the online application form for the post of HCS (Ex Br) and other allied services (P-2), pursuant to advertisement dated 02.08.2018 (P-1), the petitioner inadvertently mentioned his category as ESP General category whereas the petitioner belongs to General category. Further he has not attached any certificate with regard to ESP general category. The petitioner has been issued admit card under ESP General Category, as per Annexure P-4. The petitioner given his representation as well on 22.03.2019 (P-5) to the Commission to change his category from ESP General to General but the same has been rejected via telephone on 22.03.2019.

Issue notice of motion.

On asking of the Court, Ms. Palika Monga, DAG Haryana and Mr Kanwal Goyal, Advocate accepts notice on behalf of the State and Commission. Learned counsel for the petitioner shall supply copy of the petition to learned opposite counsel by today itself.

CWP No. 8230-2019 After hearing learned counsel for the petitioner, it seems that he has inadvertently mentioned his category in his application form as General ESP instead of General, which is evident from the fact that he has not attached any Sports certificate along with his application form. In view of the above factual position, the writ petition is allowed and respondent-Commission is directed to consider the candidature of the petitioner under General Category instead of General ESP, pursuant to advertisement dated 02.08.2018 (P-1).

A copy of this order be given dasti to learned counsel for the petitioner as well as to learned counsel appearing for the Commission under the signatures of Reader attached to this Court.
