*** Anupinder Singh Grewal, J. (Oral) The petitioner is seeking regular bail in FIR No.61 dated 18.04.2019 under Section 21 of the NDPS Act, registered at Police Station Sarabha Nagar, District Police Commissionerate Ludhiana. Learned counsel for the petitioner contends that the alleged recovery which has been effected from the petitioner is 310 grams of heroin. He also contends that the petitioner, who is 25 years of age, is in custody for over two years and and two months and is not involved in any other case under the NDPS Act.

Learned State counsel, upon instructions from SI Balbir Singh, states that PW-1 has been examined in-chief and there are 18 other prosecution witnesses.

Heard through video conferencing.

In view of the above especially when the petitioner is in custody for over two years and two months, he is not involved in any other case under

CRM-M-20912-2021 -2- ---------- the NDPS Act, Covid-19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
