******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.303 dated 20.05.2018 registered for offences punishable under Sections 406/420/506 of Indian Penal Code, at Police Station Sadar Dadri, District Charkhi Dadri.
Heard.
Learned State counsel submits that petitioner has joined the investigation, however, an amount of `9 lakhs, which he allegedly received from the complainant has not been recovered from him. Allegations against the petitioner are that he received a sum of `9 lakhs from complainant for his recruitment as Station Master. The petitioner has also given a cheque to complainant in this regard. Keeping in view the fact that allegations levelled by the complainant are subject matter of investigation, completion of which will take considerable time and thereafter, presentation of challan and JITENDER KUMAR 2018.09.12 18:06 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH
CRM-M-27355 of 2018 -2conclusion of trial will also take long time, the instant petition is allowed and order dated 04.07.2018 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court.
(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
