RFA No. 2183 of 1998

IN THE PUNJAB AND HARYANA HIGH COURT

AT CHANDIGARH RFA No.2183 of 1998 (O&M) Date of Decision: 31.8.2015 State of Haryana and another ...Appellants

Versus

Nanak Chand and others .....Respondents CORAM: Hon'ble Mr. Justice Rajesh Bindal

Present:

Mr. Randhir Singh, Additional Advocate General, Haryana. None for the landowners.

RAJESH BINDAL, J.

This order will dispose of four appeals bearing RFA Nos. 2183, 3781 of 1998, 559 of 1999 and 3374 of 2002, as common questions of law and facts are involved therein.

The State is in appeals seeking reduction in the amount of compensation for the acquired land.

Brief facts of the case are that the State of Haryana vide notification dated 10.12.1992, issued under Section 4 of the Land Acquisition Act, 1894 (for short 'the Act') sought to acquire land situated within the revenue estate of village Palwal, Tehsil and District Faridabad, for development and utilization thereof as residential area for Sectors 1 and 2, Palwal. The Land Acquisition Collector (for short "the Collector") assessed the market value of the acquired land @ ` 2,35,000/- per acre. The landowners feeling dissatisfied with the award of the Collector, filed objections. Considering the material placed on record, the learned court below vide different awards, determined the market value of the acquired land @ ` 180/- per square yard.

Learned counsel for the State conceded that the claim made in the present set of appeals is squarely covered by the judgment of this Court in RFA No. 473 of 1998--State of Haryana and another v. Pohap Singh , SHARMILA 2015.09.02 15:47 I attest to the accuracy and authenticity of this document.

RFA No. 2183 of 1998 decided on 7.10.1999, whereby compensation for the acquired land was further enhanced.
