The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner in case FIR No.15 dated 07.03.2024 under Section 304 IPC registered at Police Station Khuhi Khera District Fazilka.

On the last date of hearing i.e. on 01.04.2024 while noticing the following submissions made by the learned counsel for the petitioner, this Court had granted the concession of interim bail to the petitioner and asked her to join investigation: "Learned counsel for the petitioner inter alia contends that as per the allegations levelled in the FIR itself which was registered on statement of the father of the deceased, the latter had fallen into bad company; resultantly the deceased purchased cocaine from the petitioner and one other person and thereafter injected it in his body. CRM-M-15784-2024 -2counsel has submitted that since it was the case of the complainant himself that his son was found in an unconscious state inside the bathroom, it was highly unbelievable that he would have been in a position to tell his father that cocaine had been supplied to him by the petitioner. Furthermore, the petitioner has no criminal antecedents which lends credence to his false implication in the instant case."

Learned counsel for the petitioner has submitted that the petitioner in compliance of order dated 01.04.2024 has joined the investigation.

Learned State counsel, on instructions, has not disputed the submission made by the counsel opposite. He on further instructions submits that the petitioner is not required for further interrogation.

In view of the above, present petition is allowed and interim order dated 01.04.2024 is made absolute subject to the conditions as envisaged in Section 438(2) Cr.PC.
