Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Ramesh Kumar, who has been booked for having committed the offence punishable under Section 135 of the Electricity Act, 2003, in a case arising out of FIR No.191, dated 05.03.2015, registered at Police Station, Anti Power Theft Verka, Amritsar. Learned counsel contends that the electricity meter was not in the name of the petitioner and he has been falsely implicated in the present case.
I have heard learned counsel for the petitioner and with his able assistance gone through the material available on record.
The present case came into existence on the basis of a SEEMA RANI 2015.09.14 16:18 I attest the accuracy and authencity of the document
Criminal Misc.No.M-26401 of 2015 [2] complaint presented by Pawan Kumar, Assistant Executive Engineer Commercial, Punjab State Power Corporation Limited, West Sub Division, Amritsar. It was alleged that Varinder Kumar was a consumer of the Electricity Department. On checking the premises, it was found that the electricity meter found tampered and on testing, the said apprehension was found correct. A penalty of `2,18,937/- (Rupees two lacs eighteen thousand nine hundred and thirty seven only) was imposed. On further verification, it was found that the petitioner was in possession of the premises where the electricity meter was installed.
No ground for grant of anticipatory bail to the petitioner is made out.
Dismissed.
