The petitioners have filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.113 dated 27.6.2017 (Annexure-P.1) registered for the offences under Sections 307, 323, 148, 149 and 341 IPC at Police Station Navi Baradari, Jalandhar, District Jalandhar.

Ms. Simranjeet Kaur, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. G.S. Rawat, learned Advocate has appeared for the complainant and contested this petition.

Cr. Misc. No.M-26463 of 2017 [2] I have heard learned counsel for the parties as well as learned Assistant Advocate General, Punjab appearing for the respondent-State and have gone through the record.

As per the prosecution version, Ajay alias Ajaik-petitioner No.1 was stated to be armed with a blunt weapon and gave simple injury on the head of Prabhjot Singh-complainant. Manjinder Singh-petitioner No.2 was stated to be armed with baseball and gave simple injury on the head of the complainant.

Both the petitioners have been in custody since 28.6.2017. The petitioners are not required for interrogation or investigation purposes as they are in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioners in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioners are ordered to be released on bail subject to their furnishing personal bonds in the sum of `50,000/- each with one surety each in the like amount to the satisfaction of the trial Court/Duty Magistrate.
