The petitioner has filed this first petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.57 dated 4.6.2015 registered for the offences under Sections 498-A, 406, 323 and 506 IPC at Police Station Sector 20, Panchkula.
I have heard learned counsel for the petitioner and have gone through the record.
The FIR in this case has been got registered on the basis of complaint given by Rajni Devi wife of the present petitioner. There are allegations against the petitioner regarding misappropriation of dowry articles like double bed, refrigerator, household goods of daily use, diamond set, gold ornaments etc. and secondly the allegations are also against him regarding abusing and giving beating etc. by him to the complainant and HARPAL SINGH PARMAR 2015.08.18 10:22 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-26429 of 2015 [2] raising the demand of car and `90,000/- in cash. It is also in the FIR that the present petitioner Harjot Singh has pushed the complainant from the stairs due to which she suffered fracture on her left leg etc. All the allegations are only against the present petitioner. Keeping in view the fact that dowry articles are still to be recovered and main allegations are regarding maltreatment are also against the petitioner and he is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
