(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.314 dated 22.07.2018 under Sections 302, 323, 34 IPC registered at Police Station Civil Lines, Kaithal to the petitioner, who is in custody since 26.07.2018 in the aforesaid FIR. Counsel for the petitioner herein would contend that a reading of the FIR would reflect that the petitioner is alleged to have caused injuries to the complainant with a knife below to his chest. It is further argued that the MLR, which is available on record as Annexure P-2, would reflect that injuries inflicted upon the petitioner were lacerated wound on left lateral side of chest, lacerated wound under chin and multiple abrasions on chest, which do not co-relate with the injuries stated to have been inflicted by the petitioner to the complainant. It is also argued that statement of doctor is available on record, which would reflect that there are no injuries on the back of chest of the complainant Mai Lal.

CRM-M No.13955 of 2020 (O&M) -2bail application by arguing that the petitioner had inflicted several injuries on the person of complainant on which account he subsequently died. Asking the counsel as to what was the postmortem report, this Court is informed that injuries suffered by Mai Lal-complainant had become infected, which ultimately caused his death. Learned counsel for the respondent-State also submits that the trial is likely to conclude as most of the witnesses have been examined.
I have heard learned counsel for the parties. While taking into consideration the MLR report and the fact that petitioner herein has already gone a substantial period of incarceration, this Court deems it appropriate to allow the petitioner regular bail. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
