M.M.S. BEDI, J. (ORAL) Petitioner is sister-in-law of respondent No.2 who has launched prosecution under Section 406 and 498-A IPC, against her husband and his family members.
Counsel for the petitioner submits that the petitioner was married prior to the marriage of the complainant and has been staying at a place which is at a distance of 40 kilometres from the residence of the complainant. It is claimed that the allegations against the petitioner are vague and uncertain and constitute no offence and that the petitioner has been arrayed as an accused with an oblique motive to harass the petitioner.
During the course of arguments, it transpires that charges have already been framed.
In view of said circumstance, petition for quashing of FIR is not maintainable.
CRM-M-26438-2015 (O&M) Counsel for the petitioner, at this stage, seeks permission to withdraw the present petition with liberty to the petitioner to file a fresh petition challenging the charges framed against him.
Disposed of as withdrawn with liberty to avail any legal remedy.
