The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.1001 dated 15.12.2013 registered for the offence under Section 420 IPC at Police Station City Thanesar, District Kurukshetra.

I have heard learned counsel for the petitioner and have gone through the record.

As per the prosecution version, the FIR was got registered by complainant Saroj Devi wife of Om Parkash with the allegation that nonapplicant Geeta Devi along with the present petitioner Karambir Tyagi and co-accused Aklakh deceived the complainant into a belief that they could get her husband and son rid off the disease they were afflicted with by way of magic and in this manner, they induced the complainant to part with huge HARPAL SINGH PARMAR 2015.08.14 14:49 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-26448 of 2015 [2] sum of money of about `17 Lacs. It is the case of the complainant that her husband Om Parkash died on 24.2.2013. The present petitioner Karambir Tyagi is named in the FIR. The main role is also attributed to him. At the time of arguments, it is argued that the amount has been deposited in the bank account of Aklakh Mohd. The petitioner is required for custodial interrogation. The amount is still to be recovered from them. Otherwise also, keeping in view the nature and gravity of the offence, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
