*** HARSIMRAN SINGH SETHI , J. (ORAL) The grievance raised in the present petition by the petitioner is that no benefit of service which the late husband of the petitioner has rendered with the respondent-Education Department has been given to the petitioner after the death of her husband, who unfortunately died on 18.11.2019. Learned counsel for the petitioner further argues that the petitioner is entitled for the benefits such as family pension, gratuity, provident fund and as well as the leave encashment, which the late husband of the petitioner was entitled for in respect of the service which have been rendered by him prior to his death.

Learned counsel for the petitioner states that there is no impediment for the release of the benefits to the petitioner but approximately one and a half year has elapsed since the death of petitioner's husband but no benefit has been extended to her though, the petitioner has also filed a representation (Annexure P-3) dated 20.2.2019 with the respondent. CWP-9014-2021 --2-- Learned counsel for the petitioner submits that the petitioner will be satisfied in case, a time bound direction will be given to the respondent to decide the representation dated 20.02.2019 (Annexure P-3) in a time bound manner by passing a speaking order.

Notice of motion.

Mr. Sharad Aggarwal, AAG, Haryana who has joined the proceedings through video conference, keeping in view the service of advance copy of petition accepts notice on behalf of respondent-State and raises no objection in deciding the representation dated 20.02.2019 (Annexure P-3) served by the petitioner in a time bound manner by passing an appropriate speaking order.

In view of the above, without expressing any opinion on the merits of the case or the grievance being raised by the petitioner in the present petition or in the representation Annexure P-3, the present writ petition is disposed of with a direction to respondent No.3 to decide the claim of the petitioner for the realse of the benefits for which the petitioner is entitled for in respect of the service rendered by her late husband namely Chet Ram, within a period of two months from the date of receipt of a copy of this order. In case, after the passing of the speaking order, it is found that the petitioner is entitled for the benefits, the same be also released to her within a period of one month thereafter.

Present writ petition stands disposed of.
