Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Ravi Mohan Bhatt, who has been booked for having committed the offences punishable under Sections 66(O) and 72 of the Information Technology Act and 120-B, 380, 420, 465, 466, 467, 468 and 477A, IPC, in a case arising out of FIR No.1485, dated 26.11.2012, registered at Police Station, City, Karnal.
Since no one has put in appearance for the petitioner, therefore, with the assistance of learned counsel for the State, the material available on record has been thoroughly scanned. As per prosecution version, the petitioner was engaged by Chief Manager, Central Bank of India, GT Road, Karnal, for repair of computers installed in the bank. During SEEMA RANI 2015.08.18 17:10
[2] the repair work, the petitioner transferred approximately ` 35,00,000/- (Rupees thirty five lacs only) in different accounts without any authority. Out of the said ` 35,00,000/- (Rupees thirty five lacs only), he withdrew ` 20,00,000/- (Rupees twenty lacs only) in cash from the said three bank accounts. Out of the said amount, a sum of ` 3,68,000/- (Rupees three lacs and sixty eight thousand only) has been recovered during investigation by the police.
Learned counsel for the State, on instructions from SI Om Parkash, Police Station, City, Karnal, points out that the petitioner is neither required nor involved in any other case. All the offences for which the petitioner has been booked are triable by learned Judicial Magistrate Ist Class. After completion of the investigation, the charge-sheet (report under Section 173, Cr.P.C.) has already been presented before learned court below.
In view of the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Ravi Mohan Bhatt, s/o Vijay Bhatt, r/o H.No.1715, Housing Board Colony, Sector 6, Urban Estate, Karnal, is directed to be released on bail during pendency of trial of the present case subject to his furnishing bond in the sum of ` 5,00,000/- (Rupees five lacs only) with one surety in the like amount to the satisfaction of learned trial court.
[3] The heavy surety has been sought for in view of the fact that huge amount allegedly withdrawn from the bank by the petitioner.
