(Oral) The present petition has been filed under Section 482 of the Cr.P.C. (Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) for seeking quashing of Complaint No.NACT/395 of 2021 titled "HDFC Bank Ltd. Vs. Prithipal Singh" pending before the Judicial Magistrate First ClassII, Kapurthala and summoning order dated 06.09.2022 alongwith all consequential proceedings arising thereform.

Learned counsel appearing on behalf of the respondent-Bank contends that as a matter of fact, the evidence of the complainant has already been closed and even the statements under Section 313 Cr.P.C. stand recorded. Now the matter is fixed for defence evidence by the petitioner herein.

In view of the fact that the trial has already reached at an advanced stage, I am of the opinion that the interest of justice would be well served in case the petitioner takes up all his pleas before the Trial Court. 3.

In view of the above, the present petition is disposed of with liberty to the petitioner to raise all his pleas before the Trial Court. 4.
