Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.133 dated 25.05.2016 under Sections 315, 420, 511 IPC and Sections 2, 4, 5 of MTP Act (Section 2 and 4 MTP Act deleted later on), registered at Police Station Old Sabji Mandi, Rohtak, District Rohtak.
Notice of motion was issued and learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner has already joined the investigation. He is not named in the FIR but has been nominated by the Vineet Gulati 2016.10.18 16:37 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-27369 of 2016 -2co-accused in the disclosure statement. The challan has already been presented in this case. The petitioner is not required for further investigation or custodial interrogation. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 19.08.2016 granting interim bail to the petitioner is made absolute.
