Prayer made in the present petition for quashing the action of the official respondents in recommending the names of respondent Nos.6 to 18 for appointment in the PCS (Executive Branch), might not, due to efflux of time, even be surviving.

In the index of the petition, reliance was placed on the pendency of CWP-4255-2004, which was dismissed.

Learned State counsel refers to the written statement filed on behalf of respondent Nos.3 to 5 by PPSC, wherein it has been stated that a threemember committee of the commission was constituted, who found that correct marks having been awarded for the ACRs and higher qualifications acquired by the candidates and resolved the anomalies regarding the grading of marks of ACRs, if any. Further that in para 4 of merits, it has been stated that petitioner had been served charge-sheet and twice show cause notices during the relevant period but was duly considered and interviewed alongwith the other candidates. However, being lower in merit was not selected for appointment in PCS (Executive Branch) through nominations for Register A-1 (recruitment process year 1994).

Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still subsists.
