*** JASWANT SINGH, J.(ORAL) Prayer is for grant of regular bail in case FIR No.423 dated 08.8.2015 under Sections 304-B/120-B IPC, P.S Manimajra, Chandigarh on behalf of accused-Rajbir Singh. As per the complainant-Kamla, her daughter Reetu was married to Dhoop Singh on 19.10.2008. Since the beginning, her husband and family of in-laws used to harass and torture her for bringing insufficient dowry. Since her unnatural death was caused within seven years of the marriage, the aforesaid FIR was lodged.

It is contended that the petitioner is the Devar and is

CRM-M No.2738 of 2016 #2# in custody since 08.8.2015. It is submitted that after completion of investigation, challan has been presented and the case is now fixed for evidence of prosecution.

Learned state counsel does not refute the factual position.

Without commenting upon the merits of the case and keeping in view the custody period and the fact that the challan stands filed and the trial is not likely to conclude in near future, no useful purpose would be served in keeping the petitioner in custody any longer.

Accordingly, the present petition is allowed and petitioner is ordered to be released on bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Chandigarh. ( JASWANT SINGH ) JUDGE February 25, 2016 manoj
