Legal representative of the deceased appellant No.1, as mentioned in para No.2 of the application, is ordered to be impleaded as a party. Vakalatnama signed by the legal representative of the deceased appellant No.1 has already been appended with the application. The same is taken on record. Amended memo of parties is also taken on record. Registry to scan and tag the same at an appropriate place.

In view of the above, the present application is allowed. With the consent of both the counsel, the main appeal is taken on Board today itself.

Learned counsel for the appellants seeks permission to withdraw the present appeal as the parties have since settled their dispute. 9.

Learned counsel for respondent No.1 has no objection in allowing the aforesaid limited prayer made by the learned counsel for the appellants.
