The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.54 dated 20.4.2015 registered for the offences under Sections 302, 307, 148 and 149 IPC at Police Station Bhagapurana, District Moga.
Notice of motion to Advocate General, Punjab. Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance and contested this petition. I have heard learned counsel for the petitioner and learned Assistant Advocate General, Punjab and have gone through the record. As per the allegations in the FIR, which was got registered by Lovepreet Kaur, the present petitioner-Shamshad Khan has been named. Cr. Misc. No.M-27404 of 2016 [2] Active role is also attributed to him in the double murder of Gurpreet Singh and Gursewak Singh. The eye witness Sukhdev Singh has not been examined so far. The trial is going on before the trial Court. At this stage, keeping in view the nature and gravity of the offences and in view of the fact that if the petitioner is released on bail there is every chance that he may tamper with the evidence, therefore, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail.
Therefore, finding no merit in this petition, the same is dismissed.
