(ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for quashing FIR No.128 dated 23.07.2016, under Sections 3 to 7 of Immoral Traffic Act (Renamed SIT) and Section 120-B IPC, Police Station City Moga (P-1) and all other proceedings arising out therefrom. In nutshell on 23.07.2016, on the basis of secret information that immoral trafficking activities were going on in Mehtab Hotel, the police raided it and arrested 15 persons from there including the petitioners. According to the petitioners, on that date, their engagement ceremony was being solemnized in Mehtab Hotel and they, with their other members, were taking their meals. However, their old members were let off by the police, but the petitioners were arrested illegally. Thereafter, marriage of petitioners was solemnized on 31.07.2016 in Gurudwara Bibi Kahan Kaur, Moga. CRM-M-26544-2017 --2-- are annexed herewith as Annexures P-3 and P-4. Since, the petitioners are married couple. Therefore, the impugned FIR No.128 dated 23.07.2016 (P-1) registered at Police Station City Moga, is not permitted to be continued against them. As such, the same is quashed along with other consequential proceedings emanating therefrom qua the petitioners only.
