CRM No. 30573 of 2015 This is an application for placing on record statement of complainant-Kulwinder Kaur recorded under section 161 Cr.P.C. Application is allowed as prayed for. Document is taken on record as annexure P-3.

CRM M-26503 of 2015 This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 31 dated 27.03.2015 under Sections 420, 120-B IPC at Police Station Chamkaur Sahib, district Rupnagar.

Complainant was duped of `24.00 lacs as he wanted his close relation to be sent abroad. Out of total amount, `5.00 lacs was paid to Amarjit Singh (petitioner herein), who is maternal uncle of the complainant. According to counsel, petitioner is in custody AJAY KUMAR 2015.09.22 14:53 I attest to the accuracy and authenticity of this document

CRM M-26503 of 2015 (O&M) since 20.05.2015. Thus, no useful purpose would be served by detaining him in custody any longer.

Learned State counsel has opposed the prayer for bail. He submits that investigation has been completed and trial is in progress.

I have heard learned counsel for the parties. Keeping in view the aforesaid contentions and period of incarceration of the petitioner, I am of the considered view that that no useful purpose would be served by detaining her in custody any longer. Without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Rupnagar.
