Present petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in case FIR No. 136 dated 25.6.2017, registered under Sections 406, 419, 420, 465, 467, 468, 471, 474 & 120-B IPC, at Police Station Sohana, District S.A.S.Nagar.
Learned counsel for the petitioner contended that petitioner is not involved in the case in any way. He has just signed the alleged affidavit dated 4.6.2014 and thereafter complaint was filed on 2.12.2015 and FIR was registered on 25.6.2017 and he is ready to join the investigation. Having considered the facts that the case against the petitioner that complainant Sohan Singh was the owner of the plot and thereafter accused Baljit Singh in connivance with his brother Ranjit Singh (present petitioner) sold the said plot to Rajwinder Kaur on 24.6.2011 and the said transfer was on the basis of documents including the said forged document i.e. affidavit. At that time, complainant was not present in India and that is Deepak Kumar Bhardwaj 2017.07.26 15:52 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-26546 of 2017 why the process of law could not be initiated by way of registration of the case. The entire matter needs to be probed thoroughly. No case is made out to grant pre-arrest bail to the petitioner and thus, the present petition stands dismissed.
