RAMENDRA JAIN, J. (ORAL) Through this petition under Section 407 IPC, prayer has been made for transfer of complaint No. COMI/118/2016 dated 17.08.2016 (Annexure P-5) titled as 'Bahadur Singh Vs. Parminder Kaur', under Sections 415, 419, 420, 494, 495, 506 and 120-B IPC, pending in the Court of Judicial Magistrate Ist Class, Rupnagar, to any Court of competent jurisdiction at Patiala.

Learned counsel for the petitioners inter alia contends that all the other cases amongst the parties are already pending at Patiala, therefore, in the interest of justice, the aforesaid complaint (Annexure P-5) may also be transferred to Patiala. Learned counsel for the respondent submits that on 08.09.2018, the petitioners with their henchmen caused injuries to the mother of respondent, when she had gone to pursue their case at Patiala, therefore, there is apprehension of danger to the life and liberty of the RISHU KATARIA 2019.02.04 18:07 I attest to the accuracy and integrity of this document

Considering overall facts and circumstances of the case, the aforesaid complaint (Annexure P-5) is ordered to be transferred from Rupnangar to the Court of competent jurisdiction at Patiala, for disposal, in accordance with law.

The Chief Judicial Magistrate, Patiala, may retain the complaint on his Board or assign it to any other Court of competent jurisdiction.

It is, however, made clear that in case, any mishap is happened with respondent or his mother in future, at the behest of petitioners, in that eventuality all the cases amongst the parties shall be transferred to the place of present posting of respondent. Disposed of.
