RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Darshan Singh @ Bhatti , in case FIR No. 92 dated 08.02.2019 registered under Section 15 of the NDPS Act at Police Station City Thanesar, District Kurukshetra. According to the prosecution, the petitioner was apprehended with conscious possession of 38 kgs. 500 grams of poppy husk containing in a plastic bag, without any permit or licence. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 08.02.2019.

In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to RISHU KATARIA 2019.04.03 15:23 I attest to the accuracy and integrity of this document
