(ORAL) Case is taken up for hearing through video conferencing. Through the instant petition under Section 438 Cr.P.C., the petitioner seeks anticipatory bail in case FIR No.199 dated 16.11.2018 registered under Sections 392, 394, 395 and 397 of Indian Penal Code, Section 25 of Arms Act and Section 21.4 (1) of Mining Act, at Police Station Khizrabad, Yamuna Nagar.

On 29.07.2020, this Court passed the following order :- "The case has been taken up for hearing through video conferencing.

The petitioner has filed the present petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in case FIR No.199 dated 16.11.2018 registered under Sections 392, 394, 395 and 397 of the Indian Penal Code, 1860, Section 25 of the Arms Act, 1959 and Section 21.4(1) of the Mines and Minerals (Development and Regulation) Act, 1957 at Police Station Khizrabad, GEETA RANI 2020.09.07 16:45 I attest to the accuracy and integrity of this document

On joint request of learned counsel for the parties, adjourned to 07.09.2020 for arguments.

In the meanwhile, the petitioner is directed to join the investigation within 15 days from the date of this order. In the event of his arrest, the petitioner shall be released on interim bail by the arresting officer/investigating officer on his furnishing of bail bonds to the satisfaction of the arresting officer/investigating officer. The petitioner shall comply with the conditions enumerated under Section 438(2) of the Cr.P.C. failing which he shall not be entitled to the benefit of protection of interim bail allowed to him." Learned counsel for the petitioner states that pursuant to the order dated 29.07.2020 passed by the Coordinate Bench of this Court, the petitioner has joined the investigation.

Learned State counsel on instructions from ASI Rajvir Singh states that the petitioner has joined the investigation and he is not required for any further investigation.

I have heard the learned counsel for the parties. In view of the above, without commenting on the merits of the case, the present petition is allowed and the order dated 29.07.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure.
