This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 47 dated 26.05.2015 under sections 354/354-A/451/323/34 IPC at Police Station Sadar Moga. Learned counsel for the State (on instructions from ASI Balbir Singh, who is present in court) submits that pursuant to order dated August 31, 2015, petitioner no. 2 has joined the investigation and is no longer required for custodial interrogation. In view of the above, order dated August 31, 2015 qua petitioner no. 2 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.

As regards petitioner no. 1, petition qua him has already been dismissed vide order dated August 31, 2015. Investigating agency is at liberty to proceed against him as per law. Disposed of.
