******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.193 dated 10.10.2016 registered for offences punishable under Sections 15 and 25 of Narcotics Drugs and Psychotropic Substances Act, 1985 at Police Station Dakha, District Ludhiana (Rural). Heard.

Recovery from the petitioner is of commercial quantity of contraband. The recovery was effected from car bearing registration no. PB01-A-7804, which belongs to Kuldeep Singh, who during investigation has stated that he had given this car to petitioner under an agreement. The petitioner was in car at the time of alleged recovery and his control over the car is also prima facie made out from statement of Kuldeep Singh, recorded by the police.

Keeping in view above facts but without expressing any opinion on merits of the case, I do not find it to be a fit case to extend the benefit of regular bail to petitioner at this stage. Dismissed.
