**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 150 dated 27.7.2016 registered at Police Station Sahnewal, District Ludhiana under Sections 363, 366-A, 120-B IPC and Section 6 and 8 of POCSO Act (Sections 376-D/328 IPC added later on).

Counsel for the petitioner contends that the petitioner is in custody since 28.7.2016. He further submits that the prosecutrix and the complainant have been examined and he seeks parity with Jagdeep Singh @ Deepa who had been allowed bail on 25.4.2018. Counsel also submits that there was delay in lodging the FIR and no spermatozoa was found in the FSL report.

The prosecutrix had named two persons. The allegations are that rape was committed three months ago. No spermatozoa was found in the FSL report. The prosecutrix had already been examined. The petitioner is in custody since July 2016.
