Counsel for the petitioners has inter alia argued that the FIR has been registered with mala fide intention of complainant- respondent No.2 by filing a complaint u/s 156(3) Cr.P.C. and that no offence is made out.
On asking of the court, counsel for the petitioners submits that on the basis of the investigation, the prosecution agency has not opted to present challan. He seeks permission to withdraw the petition at this stage being pre-mature, without prejudice to the right of the petitioners to avail the legal remedy in case the prosecution agency opts to proceed against the petitioners by presenting challan.
Disposed of as withdrawn at this stage.
