NIDHI GUPTA, J. (ORAL) The matter has come up for hearing after the year 2019. Vide last order dated 29.10.2019, the appellant had gone unrepresented and the Registry was directed to issue notice to learned counsel for the appellant.

As per office report dated 15.11.2023, learned counsel for the appellant has been informed about the date fixed in the present appeal through e-mail. Today, again the appellant had gone un-represented, despite the case having been called twice. Therefore, it can safely be presumed that the appellant or its counsel is no more interested in pursuing the instant regular second appeal. Thus, this Court has been left with no other option except to dismiss the instant regular second appeal for non-prosecution. Ordered accordingly.
