Prayer in this petition filed under Article 226 of the Constitution of India is for issuance of a writ in the nature of certiorari seeking quashing of impugned condition of putting cut-off date as 28.10.2005 in Para No.5(i) of Office Memorandum dated 08.05.2023 (Annexure P-16) issued by respondent-Finance Department, being illegal, arbitrary, unconstitutional and in violation of the basic spirit of the Office Memorandum issued by Government of India dated 03.03.2023 (Annexure P-14). The petitioners have further sought quashing order dated 07.11.2025 (Annexure P-15), whereby the department has override the rules and rejected to entertain the claim of the petitioners stating that letter dated 08.05.2023 (Annexure P-16) is not applicable to Board/Corporation.

Learned counsel for the petitioners submits that he would be satisfied if the representation dated 21.03.2023 (Annexure P-6) and representation dated 12.07.2024 (Annexure P-7) of the petitioners are decided by respondent No.3 by passing a speaking order in a time bound manner. appearing on advanced notice, submits that he has no objection in case a direction is issued to respondent No.3 for time-bound consideration and decision of the representation dated 21.03.2023 (Annexure P-6) and representation dated 12.07.2024 (Annexure P-7) of the petitioners by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.3 is directed to consider the representation dated 21.03.2023 (Annexure P-6) and representation dated 12.07.2024 (Annexure P-7) of the petitioners and pass a speaking order, after affording them an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by the respondents.
