The petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.78 dated 3.5.2015 registered for the offences under Sections 323, 324, 354 and 34 IPC at Police Station Division No.5, Jalandhar.

I have heard learned counsel for the petitioners and have gone through the record.

From the perusal of the impugned order passed by the learned Additional Sessions Judge, Jalandhar, I find that earlier the interim bail was granted by the Court in this FIR, but when the accused were on interim bail, then again they caused injuries to the family members of the complainant in order to threaten the complainant.

Cr. Misc. No.M-26655 of 2015 [2] registered by Balvir Kumar father of complainant Nisha is a false FIR. At this stage, there is nothing on record that it is a false FIR. Rather, copy of the subsequent FIR has also been placed on record according to which the injuries were given to Balvir Kumar and Paramjit Kaur father and mother of Nisha.

Keeping in view the above facts and circumstances that during the period when the petitioners were on interim bail, they again caused injuries to the complainant's family, I do not find it a fit case where the present petitioners are entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
