PANKAJ JAIN, J. (ORAL) Petitioner herein prays for issuance of a writ in the nature of certiorari quashing the order dated 30.08.2022 (Annexure P-8) vide which the appeal filed by the petitioner stands dismissed and that dated 21.01.2019 (Annexure P-5) whereby the petitioner has been ordered to be dismissed from service.

Petitioner who is serving in the department of Police as Home Guard is admittedly a convict in FIR No.52 dated 22.02.2007 registered for the offence punishable under Section 61/1/14 of the Excise Act at Police Station 36, Chandigarh and FIR No.9 dated 06.01.2009 registered for the same offence.

Counsel for the petitioner does not dispute that in view of the conviction earned by the petitioner no fault can be found with the order dismissing him from the service in view of clear mandate of Article 311 of the Constitution of India.
