**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.91 dated 26.01.2015, under Sections 346, 376-D, 342, 120-B and 506 IPC and Section 4 of POCSO Act, 2012, registered at Police Station City Panipat.

Learned counsel for the petitioner submits that the prosecutrix is a habitual of making false allegations against the persons of similar nature. In the present case, Sandeep (co-accused of the petitioner), who was also summoned on an application filed by the proseuction under Section 319 Cr.P.C, along with the petitioner, has already been granted concession of regular bail by this Court, vide order dated 01.08.2016 in CRM-M-186122016. Since, the petitioner is in custody from 04.02.2015, so, he be released Naresh Kumar 2016.09.22 10:10 I attest to the accuracy and integrity of this document Chandigarh on regular bail.

CRM-M-27574-2016 -2I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 04.02.2015. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Panipat.

Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
