(ORAL) The petitioner, through instant petition under Section 482 Cr.P.C. is seeking directions to official respondents to conduct fair and impartial inquiry in FIR No. 0125 dated 09.03.2020, under Sections 34, 341, 376 and 506 IPC, registered at Police Station, Palam Vihar, District Gurugram.
Reply by way of affidavit dated 20.4.2023 of Manoj Kumar, Assistant Commissioner of Police, Udyog, Gurugram on behalf of respondents No. 1 to 3 is taken on record. Registry is directed to tag the same at an appropriate place. Learned State counsel pointing out State reply submits that investigating officer, in the investigation, has found private respondents innocent and cancellation report has been prepared. She further submits that on account of Covid-19 it could not be filed and PARAMJIT KAUR SAINI 2023.04.24 17:42 I attest to the accuracy and authenticity of this order/judgment
2023:PHHC:057085 CRM-M-16836 of 2023 -2now it is in process and would be filed within one month from today. In view of statement of learned State counsel, no further order is warranted. The petitioner is at liberty to avail remedies as permissible by law as and when report under Section 173 Cr.P.C. is filed.
